Bankruptcy Law Courses in Florida

Unlike tax law, bankruptcy law can only be practiced by licensed attorneys. For this reason, bankruptcy law courses are taught to law students within a law school setting. Bankruptcy laws may also be taught to practicing attorneys as a part of their continuing legal education requirements. The state of Florida houses several law schools that offer courses in bankruptcy law. The following law schools are accredited by the American Bar Association and offer courses in the state of Florida. - The University of Florida Levin College of Law offers courses in Creditors' Remedies & Bankruptcy and Advanced Problems in Bankruptcy and Debtor-Creditor Law. The bankruptcy portion of the three-credit-hour Creditor's Remedies & Bankruptcy course focuses on liquidation proceedings and a trustee's power to avoid property transfers. The four-hour version of the class goes into great detail concerning business bankruptcy workouts. To be eligible for the advanced course, the student should have already taken the course previously mentioned or Debtor-Creditor Law. In Advanced Problems in Bankruptcy and Debtor-Creditor Law, the student will learn the bankruptcy process and gain a greater appreciation for the philosophy and reasoning behind the federal bankruptcy code.

law.ufl.edu - Florida State University offers two courses in bankruptcy law. In the first course, Bankruptcy, the student studies the legal principles governing debtor-creditor relationships. The course emphasizes bankruptcy law and the rights of unsecured creditors, whose debts will presumably be discharged in a bankruptcy case. The course also covers state remedies such as garnishment, attachment, execution, fraudulent conveyance and debtor's exemptions. A student must have taken this course before enrolling in the Bankruptcy Policy Seminar. Issues discussed in Bankruptcy Policy Seminar are advanced problems in bankruptcy policy, which includes the economic efficiency of the bankruptcy process, the scope of fraudulent conveyance law and the discharge of debts.

law.fsu.edu - The University of Miami School of Law offers an annual Bankruptcy Skills Workshop to experienced attorneys and their paralegal staff. In this workshop legal professionals gain knowledge of the procedural and substantive components of bankruptcy law, local rules and filing requirements for the United States Bankruptcy Court for the Southern District of Florida. The workshop focuses on Chapter 7 consumer liquidation and Chapter 13 debt reorganization. The workshop also covers debtor eligibility, dischargability of debt, powers of the trustee and property of the bankruptcy estate.

The law school also offers a bankruptcy judicial internship. During this internship, a student will work closely with the bankruptcy judge for the Middle District of Florida and law clerks for an entire semester. The intern will perform research and writing assignments with respect to cases brought before the court. This course requires the prerequisite of Bankruptcy or Bankruptcy Seminar.
