Colorado Do Not Call Law
- According to the Colorado Public Utilities Commission (PUC), the website and database for the No-Call List are operated by Data Protection Group LLC. This private organization was chosen through a competitive bidding process in 2006. See Resources for the link to the Colorado No-Call List's official website. At this site, consumers can register residential, wireless and fax numbers. To do so, an individual has to enter his phone number and zip code. There is no charge to join the list. According to the site, it is illegal to remove someone's phone number from the list without authorization.
- According to the PUC, telemarketers must register and submit a registration fee to the designated agent, which is Data Protection Group LLC as of 2010. The registration fees are annual and based on the total number of employees at the telemarketing firm. As of 2010, the maximum fee is $500 for businesses with more than 1,001 employees. As part of the registration, subscribing businesses will receive an updated Colorado No-Call List four times a year. The Public Utilities Commission may change the fee as necessary.
- Certain organizations are permitted by the law to call registered numbers. According to the PUC, this includes charitable organizations complying with mandatory state requirements; persons or entities encouraging support or opposition of political candidates or issues, or conducting political polls; persons or entities that have established a previous business relationship with the consumer; persons or entities with prior invitation or permission; or a business that has been contacted, within 30 days, about the potential purchase of goods or services.
- According to the PUC, violation of the No-Call List is considered a deceptive trade practice. According to the official Colorado No-Call List website, a telemarketer must call any number on the list three or more times in a month in order to be in violation of the law. All three calls do not have to be to the same number.
- Individuals with a complaint are asked to file a complaint on the PUC website or by calling 800-309-7041. The Colorado No-Call List Act is enforced by the Attorney General's Office. The PUC also states that consumers may "pursue private remedies, such as small-claims court action, under the Consumer Protection Act."
